What is permitting?

A permit is a legal authorization issued by a government agency that allows a specific activity — often construction — or project to proceed under defined conditions. When we talk about 'permitting reform,' we're talking about changes to these authorization processes, as well as related barriers to infrastructure deployment like transmission planning.

Projects often require multiple permits from local, state, and/or federal agencies. These permits are designed to protect public health, safety, and the environment. They influence project timelines, costs, and sequencing — and some require agencies to complete environmental reviews or consultations before a final decision is issued.

Congress' Role in Permitting

Congress establishes statutory timelines, standards, and agency authorities. Appropriations and oversight shape how permitting laws are actually implemented in practice. Most permitting reform discussions focus on improving efficiency while maintaining environmental protections — not removing accountability from the process.


What shapes permitting timelines?

Federal permits are issued under many different laws and by many different agencies. How long a project takes to receive final approval is determined by a combination of factors:

  • Statutory requirements set by Congress — including environmental review obligations
  • Environmental review processes — especially the National Environmental Policy Act (NEPA), which requires agencies to evaluate impacts of projects with a federal nexus
  • Interagency coordination and sequencing — multiple agencies often review the same project, sometimes sequentially
  • Public input and consultation requirements — including tribal consultation and public comment periods
  • Litigation risk and judicial review — legal challenges can add years to project timelines, even when projects ultimately prevail in court
  • Federal agency staffing and resources — agencies that are understaffed or underfunded move more slowly, regardless of statutory timelines

Key Insight: NEPA requires federal agencies to evaluate the environmental impacts of projects with a federal nexus — meaning any project involving federal land, federal permits, or federal funding. These reviews can take many years and trigger years-long lawsuits. One missed opportunity this creates: only 4% of U.S. renewable power is currently generated on federal lands, even though 28% of all U.S. land is federally managed and much of it overlaps with the nation's best solar and geothermal potential.


The Grid Needs More Capacity

Transmission: A Highway System for Electrons

Big new power-generating facilities — wind farms, solar arrays, geothermal plants — tend to be located away from the households and businesses that need clean power. Transmission lines are the highway system for electrons: without them, cheap clean energy can't get where it's needed. And traffic jams can slow everything down.

Right now, the U.S. is expanding its electric transmission infrastructure at only 1% per year. We need to double or triple our transmission capacity by 2050 to meet rising electricity demand and enable the clean energy transition. Transmission line projects generally take 5–15 years to complete — and dysfunctional transmission planning and cost-allocation processes create bottlenecks even before formal permitting begins.

The Grid Needs More Capacity

More transmission capacity doesn't just enable more clean energy — it also makes the grid more stable, secure, and affordable. When regions are well-connected, they can share power during emergencies, reducing the risk of cascading failures like the 2021 Texas power crisis.

Most of What's Waiting Is Clean

The data is striking: the overwhelming majority of energy projects currently waiting in the queue to connect to the grid are clean energy projects — solar, wind, and battery storage. These are exactly the projects we need to build. And most new power generation being deployed today is clean, with over 90% of new U.S. power capacity added in 2025 coming from clean sources.

Key Insight: Permitting isn't slowing down a random mix of projects — it's primarily slowing down clean energy. That's the core case for reform: if we want to build clean energy faster, we need to fix the processes that are making it slow.


The real cost of slow permitting

Delays in building clean energy aren't just an inconvenience. Air pollution causes approximately 250,000 deaths per year in the United States, with disadvantaged communities bearing a disproportionate share of that burden. Every year of delay in building clean energy is a year of avoidable pollution and preventable harm.

How the Energy Ecosystem Has Changed

Understanding why permitting reform matters so much right now requires understanding how the energy landscape has shifted over the past decade.

Then: 2005–2015

  • The fracking boom made natural gas cheap, dominating new power generation
  • Solar was expensive and not yet cost-competitive
  • Power demand was relatively flat
  • Blocking fossil fuel infrastructure — like the Keystone XL pipeline — was a meaningful climate strategy, because new fossil fuel projects were where the growth was

Now

  • Clean energy — solar and wind — is the cheapest source of new electricity
  • Fossil fuel growth is constrained by both demand and supply chain limits
  • Power demand is rising fast, driven by data centers, electrification, and manufacturing reshoring
  • The overwhelming majority of projects waiting in the interconnection queue are clean energy


Key Insight: The energy ecosystem has changed fundamentally. A strategy focused on slowing down permitting made sense when fossil fuel projects were what was getting built. Today, what's in the queue is mostly clean energy — which means slow permitting is now a bigger obstacle to climate progress than to fossil fuel growth. Building clean power fast is the climate strategy of this moment.


Status quo = More fossil fuels

This is not a hypothetical concern. When clean energy projects are delayed and electricity demand keeps rising, the gap gets filled — by existing fossil fuel plants that were scheduled for retirement being kept online, by mothballed peaker plants being brought back into service, and in some cases by new fossil fuel generation. Slow permitting doesn't freeze the energy system; it tilts it toward fossil fuels by default.

What About Climate Pollution?

The climate case for permitting reform is grounded in hard data. RMI (Rocky Mountain Institute) analyzed the Energy Permitting Reform Act (EPRA) and estimated that transmission permitting reforms alone could reduce U.S. grid emissions by approximately 6.5 billion tons of CO₂ equivalent cumulatively through 2050.

The climate impact of transmission permitting reform is, in effect, equivalent to restoring the IRA, and then some. This is not a secondary policy priority — it's the big climate policy opportunity of this moment.

The Permitting Reform Calculus

Putting it all together, the case for permitting reform rests on three interconnected facts:

  • We need to build clean energy faster for the climate. Permitting reform is one of the most powerful tools available to accelerate the clean energy buildout and cut climate pollution.
  • We need to build clean energy faster for Americans' health, affordability, and energy security. The benefits extend far beyond climate — to public health, economic competitiveness, and energy independence.
  • Most of what's being slowed down by the permitting process is clean energy. Fixing permitting means building the right things faster.

CCL's permitting priorities

CCL's approach is to evaluate permitting reforms on whether they are a net benefit for the climate — supporting changes that accelerate clean energy deployment while maintaining strong environmental review and meaningful community engagement.

CCL is engaging on four key areas of permitting reform:

  • Transmission Reform — Expanding the grid to unlock clean energy's potential
  • Build Faster — Reforming NEPA and judicial processes to speed up clean energy permitting
  • Fair Permitting Certainty — Ensuring that approved projects can actually be built, regardless of who is in the White House
  • Community Engagement — Ensuring local voices are meaningfully included in permitting decisions
